{"id":13478,"date":"2026-04-26T22:38:32","date_gmt":"2026-04-26T15:38:32","guid":{"rendered":"https:\/\/potretkita.com\/?p=13478"},"modified":"2026-04-26T22:40:45","modified_gmt":"2026-04-26T15:40:45","slug":"teguran-kemenpanrb-ke-dlh-bekasi-disorot-awpi-desak-putusan-ptun-segera-dieksekusi","status":"publish","type":"post","link":"https:\/\/potretkita.com\/?p=13478","title":{"rendered":"Teguran KemenPANRB ke DLH Bekasi Disorot, AWPI Desak Putusan PTUN Segera Dieksekusi"},"content":{"rendered":"<p><span style=\"color: #ff0000;\"><strong>potretkita.com<\/strong><\/span> | Kota Bekasi \u2013 Dewan Pimpinan Cabang Asosiasi Wartawan Profesional Indonesia (DPC AWPI) Kota Bekasi menyampaikan apresiasi terhadap langkah tegas Kementerian Pendayagunaan Aparatur Negara dan Reformasi Birokrasi (KemenPANRB) yang menerbitkan surat teguran kepada Kepala Dinas Lingkungan Hidup (DLH) Kota Bekasi.<\/p>\n<p>Surat bernomor B\/7\/PW.01\/2026 tertanggal 23 April 2026 tersebut diterbitkan sebagai tindak lanjut atas belum dilaksanakannya putusan Pengadilan Tata Usaha Negara (PTUN) Bandung Nomor 149\/G\/KI\/2024\/PTUN.BDG yang diputus pada 7 Januari 2025.<\/p>\n<p>DPC AWPI Kota Bekasi menegaskan, putusan PTUN Bandung telah mengabulkan gugatan pihaknya dalam sengketa informasi publik dan memerintahkan DLH Kota Bekasi untuk membuka informasi yang dimohonkan secara penuh.<\/p>\n<p>&#8220;Putusan tersebut telah berkekuatan hukum tetap (inkracht) setelah upaya hukum lanjutan ditolak. Namun hingga April 2026, DLH Kota Bekasi belum melaksanakan amar putusan tersebut,&#8221; ujar Jerry Ketua DPC AWPI dalam keterangannya. Minggu (26\/4\/2026).<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Sorotan Kepatuhan Hukum<\/strong><\/span><\/p>\n<p>AWPI menilai, langkah KemenPANRB merupakan bentuk nyata pengawasan terhadap kepatuhan pejabat publik terhadap putusan pengadilan. Namun, kondisi ini sekaligus menjadi sorotan serius terhadap komitmen Pemerintah Kota Bekasi dalam menegakkan supremasi hukum.<\/p>\n<p>Dalam pernyataan sikapnya, AWPI mendesak Kepala DLH Kota Bekasi untuk segera melaksanakan putusan PTUN tanpa syarat. Keterlambatan eksekusi dinilai berpotensi mencederai prinsip keterbukaan informasi publik dan akuntabilitas pemerintahan.<\/p>\n<p>Lebih jauh, AWPI mengingatkan bahwa berdasarkan Pasal 116 Undang-Undang Nomor 5 Tahun 1986 tentang PTUN, pejabat yang tidak melaksanakan putusan pengadilan yang telah inkrah dapat dikenakan sanksi berupa uang paksa (dwangsom) hingga sanksi administratif.<\/p>\n<p>Selain itu, merujuk pada Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil, pejabat yang mengabaikan teguran berpotensi dikenakan sanksi disiplin berat.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Kritik Terhadap DLH dan Pemkot Bekasi<\/strong><\/span><\/p>\n<p>Sikap DLH Kota Bekasi yang belum menindaklanjuti putusan pengadilan dinilai mencerminkan lemahnya kepatuhan terhadap hukum. Kondisi ini tidak hanya berdampak pada citra institusi, tetapi juga berpotensi menggerus kepercayaan publik terhadap pemerintah daerah.<\/p>\n<p>AWPI menegaskan bahwa gugatan yang diajukan bukan semata kepentingan organisasi, melainkan bagian dari upaya menegakkan Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik.<\/p>\n<p>&#8220;Informasi publik adalah hak masyarakat. Penolakan atau pengabaian terhadap putusan pengadilan dalam perkara ini mencerminkan resistensi terhadap transparansi,&#8221; tegasnya.<\/p>\n<p>AWPI juga meminta Wali Kota Bekasi sebagai atasan langsung Kepala DLH untuk mengambil langkah tegas dan memastikan putusan pengadilan dijalankan.<\/p>\n<p>&#8220;Putusan pengadilan bukan untuk dinegosiasikan, melainkan wajib dilaksanakan.
