Lahan seluas 531 meter persegi yang berada di lokasi strategis itu kini menjadi objek sengketa setelah pemilik resminya menggugat dua pihak yang diduga menguasai dan memanfaatkan tanah tanpa dasar hukum. Perkara tersebut telah memasuki proses persidangan di Pengadilan Negeri Bekasi.<\/p>\n<p>Baskoro Rianda, pemilik sah berdasarkan Sertifikat Hak Milik (SHM) Nomor 4676, menggugat dua pihak yang disebut membangun dan memanfaatkan sebagian lahan tanpa izin. Tanah berbentuk segitiga tersebut memiliki batas-batas yang jelas, dengan sisi barat 50,86 meter berbatasan dengan Jalan Raya Cikunir dan sisi timur 44,71 meter berbatasan dengan Jalenas.<\/p>\n<p>Kuasa hukum penggugat,Dr. H. D. Andry Effendy, S.H., M.H dari Kantor Advokat dan Penasehat Hukum Andry Effendy dan Rekan, menjelaskan bahwa tanah tersebut diperoleh kliennya melalui hibah dari orang tua.<\/p>\n<p>\u201cPenggugat mendapat tanah ini berdasarkan Akta Hibah Nomor 11\/2019 yang dibuat PPAT Yenniarti Sani SH MKn. Kepemilikan telah tercatat dalam Buku Tanah BPN atas nama Baskoro Rianda,\u201d ujar Andry, Sabtu (15\/11\/2025).<\/p>\n<p>Dr, Andry Mengungkapkan, Masalah mulai muncul pada 2022 ketika penggugat mendapati Tergugat I, MT, telah mendirikan bangunan permanen berupa bengkel mobil dan dua kios. Di sisi lain, Tergugat II, MR, memanfaatkan bagian lain lahan untuk usaha pengumpulan barang bekas.<\/p>\n<p>\u201cTidak ada perjanjian, izin, ataupun dasar hukum yang mengizinkan mereka menggunakan tanah milik penggugat. Semua dilakukan untuk kepentingan pribadi dan komersial,\u201d tegas Andry. Kepada media Sabtu (15\/11\/2025).<\/p>\n<p>Menurutnya, Merujuk Pasal 570 KUH Perdata, hak milik memberikan kewenangan penuh kepada pemilik, termasuk melarang pihak lain menguasai tanpa persetujuan. Atas dasar itu, penggugat mendaftarkan perkara dengan Nomor 275\/Pdt.G\/2025\/PN Bks pada 10 Juni 2025.<\/p>\n<p>Selain menggugat MT dan MR, BPN Kota Bekasi turut menjadi pihak tergugat dalam perkara ini. Di persidangan, penggugat menyerahkan salinan SHM karena dokumen asli sedang dijaminkan di Bank Mandiri. Hal tersebut diperkuat dengan surat resmi dari pihak Bank Mandiri yang memastikan bahwa SHM Nomor 4676 memang masih berlaku dan berada dalam status jaminan.<\/p>\n<p>&#8220;BPN Kota Bekasi juga menyerahkan bukti salinan Buku Tanah Hak Milik Nomor 4676\/Jakamulya yang secara jelas mencantumkan nama Baskoro Rianda sebagai pemilik sah. Buku tanah itu juga memuat asal-usul kepemilikan yang berasal dari Akta Hibah tahun 2019,&#8221; jelasnya.<\/p>\n<p>Andry turut meluruskan informasi yang beredar dari kuasa hukum tergugat I di media lain, yang menyebut sertifikat terbit pada 1982.<\/p>\n<p>\u201cTanggal 10\/01\/1982 itu adalah tanggal lahir penggugat, bukan tanggal penerbitan sertifikat. Ini kesalahan membaca data yang kemudian dijadikan dasar untuk menyesatkan opini publik,\u201d tegasnya.<\/p>\n<p>Ia memastikan seluruh data fisik dan yuridis telah terverifikasi melalui aplikasi resmi BHUMI ATR\/BPN. Semua informasi menunjukkan konsistensi bahwa Baskoro Rianda adalah pemilik sah.<\/p>\n<p>\u201cTindakan para tergugat tidak memiliki dasar hukum dan merugikan hak penggugat.
